As its only present in Latam older Neo’s, shouldn’t it be considered a older livery and therefore not be featured as the rules says ?

No because latam’s livery doesn’t account for the mask, otherwise they’d change it as well for the 787 and other planes, but idk tbh, this is just my opinion I might be wrong
If they allowed the XBG request, clearly a special livery, why shouldn’t this one be allowed?

XBG is a permanent livery, just like the Jetblue’s hundred others liveries. And this one without the mask should fit into the “current livery” part of the rule
