Is it too hasty and harsh to give me a Level 3 violation without any warning?

Today, when I entered the final approach control zone in Vienna, I made a low-level and foolish mistake. I was supposed to adjust the plane’s orientation to 290 according to ATC instructions, but I accidentally touched the speed next to it, causing the speed to exceed 260. Therefore, ATC gave me a Level 3 violation.


I feel guilty for my actions and deeply apologize for them.But I believe that the remedial measures I have taken can avoid incurring a third level violation.
Firstly, as soon as the overspeed warning sounded, I immediately took measures to slow down by retracting the aircraft’s thrust lever and pulling open the spoiler as quickly as possible.
Secondly, after assessing my distance from the front aircraft, I decided to climb to 9000 feet on my own. Although this violates ATC instructions, it ensures the safety of me and other aircraft.

At this time, following or waiting for further instructions from ATC would pose a serious threat to oneself and other aircraft, so I believe taking such action is the correct and necessary way to avoid further deterioration of the situation. This is also my obligation and responsibility as a pilot.
Finally, after ensuring the safety of myself and other aircraft, I began to execute the last instruction given by ATC. At the moment I completed this command, ATC issued a Level 3 violation to me.

I deeply apologize for my unintentional mistake, but I believe that I have been doing my utmost to protect the safety of myself and other aircraft until the end of my actions. So is it too hasty and harsh to give me a Level 3 violation without any warning?
